“¿Dónde está esa criaturita?”, se pregunta una y otra vez Isabel Rinaldo, lleva cuatro años sin saber del paradero de su hija menor desde que la Fiscalía las separó, uno de los muchos casos de los niños separados de sus padres en Venezuela. El hecho ocurrió tras ser denunciada por su esposo, por supuesto abuso sexual a la niña, un delito que ella niega y que trató de demostrar sin éxito. Hoy, la pequeña es considerada por la Interpol persona desaparecida.
En la entrada de su casa, Isabel tiene una pared repleta con fotos del último rostro que conoció de su hija Keira, cuando tenía ocho años, una caja con recortes y dibujos de la niña dedicados a su madre. Uno de ellos es una especie de caramelo con palito violeta con ojos y boca. Hay también corazones o caballos. “Los amo, angelitos”, se lee en uno.
Hace cuatro años, Isabel fue acusada por su expareja de trato cruel y presunto abuso sexual contra la pequeña. Lógicamente, enfatiza Isabel, no existía ninguna prueba que sustentara esas acusaciones.
“Me presenté en el Ministerio Público con la niña para que le realizaran pruebas físicas y psicológicas. Nos separaron de áreas, hicieron la orden de aprehensión en mi contra, me detuvieron una noche. Al día siguiente me dejaron libre y ahí es cuando me quitan a mi hija”, relata.
“Se la entregaron al papá y ese hombre desapareció de Venezuela”, dice Isabel. Su expareja es extranjero y no reside en el país. Ella sospecha que la niña está fuera.
“Yo sigo buscando a mi hija en todo el mundo, que se publique su foto, alguien la tiene que ver”, dice a EFE, entre lágrimas.
A Isabel, una corte venezolana le otorgó en 2019 la custodia de su hija e Interpol emitió, inclusive, una alerta amarilla para encontrarla.
No es consuelo. Para ella, la única justicia posible es tener a Keira de vuelta. Mientras sigue soñando con ese abrazo del reencuentro.
Niños sin infancia
El director de la ONG Funvenides, Martín Geymonat, explicó que, a través de grupos de abogados y en complicidad con muchos jueces, se hacen domicilios falsos, registros escolares alterados, testigos inexistentes para obtener permisos de viajes, ejercicios unilaterales de patria potestad o sentencias de custodia.
Con una sentencia fraudulenta el niño es trasladado entre diferentes países. Esto es lo que se llama el fraude judicial, dice el experto. Insiste en que estos no son casos aislados, es una práctica continuada.
Geymonat señaló que su organización ha recibido y verificado 108 causas con casos de Perú, Argentina, Brasil y Estados Unidos de niños que no son venezolanos. No estaban domiciliados en Venezuela y los trasladaron de sus respectivos países a una tercera nación utilizando los tribunales venezolanos.
“Ya se habla de un combo, esa es la palabra que se utiliza en la región. Un combo donde unos escritorios jurídicos ofrecen una sentencia venezolana con custodia preventiva o ejercicio unilateral de patria potestad para un niño extranjero”, explicó.
Desde hace más de cuatro años, Luis Dezerega no ha podido ver a su hija de nueve, más de la mitad de su vida, lamenta. Su exmujer los separó con acusaciones amañadas en los tribunales.
Niños de Venezuela
“Hay un combo, un menú para los papás, es muy difícil comprobar ventas, cobros de favores negociados, tráfico de influencias. Pero en mi caso no me cabe la menor duda”, dice a este hombre que ha participado en huelgas de hambre para que su voz se escuche.
“No estamos hablando de tráfico de gasolina, o tráfico de especies o de lo que sea, no; estamos hablando de niños, desaparición de niños, de hijos en Venezuela”, exclamó.
Consultado por un portavoz del Ministerio Público indicó que el fiscal no va a comentar por ahora sobre estos casos de los niños en Venezuela.
“No sé dónde se encuentran”
“Buenos días, Jhon. ¿Cómo están los niños? ¿Dónde están?”, escribe todos los días Lilly Guevara al padre de sus niños de cuatro y seis años, a quienes no ha visto desde 2018. Un tribunal la declaró ausente y le otorgó la patria potestad a su expareja, un juez venezolano.
“El padre de mis hijos es juez acá en Venezuela en el Palacio de Justicia y él ha utilizado su cargo para conseguir beneficios propios. Uno de ellos es pedir un ejercicio unilateral de la patria potestad”, agrega esta mujer de 38 años, que denuncia que los tribunales no admiten sus demandas.
Lilly asegura que fue víctima de violencia de género; tiene exámenes forenses y un testigo presencial que lo confirma, pero su caso fue sobreseído.
“Con su investidura de poder, hace abuso de poder”, lamenta esta mujer, tras asegurar que no tiene miedo a denunciar al funcionario. “Yo ya estoy agotada”.
